Data Protection under Turkish laws


Indeed, processing of personal data is also a legal concern in Turkey since the enactment of the European Union Data Protection Directive No. 95/46/EC.

Turkey being in accession step within EU, a Draft Law Concerning Protection of Personal Data has been approved by Turkish Parliament on 2004. The Draft law includes the establishment of a "Data Protection Authority". However, such law is still a draft and consequently, there is no Data Protection Law in Turkey yet.

Turkey is a member of the Council of Europe and has signed the Council's Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data (ETS No. 108) in 1981. However, Turkey has also not ratified that Convention yet.

Therefore, there is no specific law on the protection of personal data in Turkey, despite pressure of European Union and Council of Europe.
